General terms and conditions

  1. Scope and General Remarks

Navigatingfintech.com is a service provided by Learning Curve Contemporary Education GmbH, Mόhlenstrasse 8a, 14167 Berlin, Germany (hereinafter “we”). 

The present General Terms and Conditions contain exclusively applicable conditions between us, and a consumer or business (hereinafter “customer”) in respect of the use of this website and the services offered by us. They can only be modified in writing. 

Consumer within the meaning of these terms and conditions is any natural person who concludes a legal transaction for purposes that are predominantly ascribable to neither his commercial nor his independent professional activity. 

Business within the meaning of these terms and conditions is a natural or legal person or a legal partnership, which acts in the execution of a legal transaction in the exercise of their commercial or independent professional activity.

  1. Applicable law and jurisdiction

The parties agree that German law shall apply between them, and that the court at our seat (Berlin) shall have jurisdiction and be competent. Mandatory provisions of the state in which a consumer has their habitual residence remain unaffected, to the extent that that state is a member state of the EU. If a consumer does not have his domicile or habitual residence in a member state of the European Union, the courts at our seat (Berlin) are exclusively responsible for all disputes.

  1. Contracts for the provision of services and purchase of goods

For the facilitation of our administrative, payment and tax procedures, we provide our services, including our online courses, under a re-seller arrangement. Our re-seller is the namotto Universal Brands GmbH & Co Ko KG, Kurfόrstendamm, 10719 Berlin, Germany, trading under the name Elopage (www.elopage.com). 

The re-seller hosts our products, such as online courses and provides the relevant payment and accounting services, including the calculation of the correct VAT, regardless in which jurisdictions our clients are located. 

When buying a good or service from our range, the relevant contract is concluded between the customer and our re-seller, and the terms and conditions of the re-seller apply accordingly. These terms and conditions are available on the reseller’s web page and are provided upon checkout every time before paying for a service or good. The re-seller, as a consequence, is also providing the relevant invoice. 

We remain responsible for customer support regarding our range of products and services.

  1. Copyright

All our products and services are protected by a world-wide copyright and relevant antiplagiarism rules. The customer is granted a non-exclusive right to use the ceded digital content. A transfer of the contents to third parties, as well as a duplication or distribution, is not permitted.

  1. Final provisions

Changes to these terms and conditions will be communicated to the customer in writing or by email. If the customer does not object to this change within four weeks after receiving the notification, the changes shall be deemed accepted by the customer.

 Should individual provisions of this contract be ineffective or contradict the statutory provisions, this shall not affect the remainder of the contract. The ineffective provision shall be replaced by mutual agreement by the contracting parties by means of a legally valid provision which comes closest to the economic purpose of the ineffective provision. The above provision applies in case of loopholes accordingly.
